The Department of State (DOS) announced the India EB-5 visa reached its annual cap for the 2026 fiscal year. This means the DOS won’t issue any EB-5 unreserved visas for Indian nationals for the rest of the fiscal year. Prospective applicants must wait until the start of the next fiscal year to apply.

The EB-5 Immigrant Investor Program grants foreign nationals a green card if they’re investing one million dollars into a new business that produces at least ten full time jobs for U.S. workers. Natives of any single foreign nation can only account for seven percent of the total employment and family-based visas. India EB-5 applicants satisfied that seven percent. The India EB-5 program is one of several employment-based visas the DOS announces for each month. Prospective applicants should wait until at least October 1, 2026. That’s when the DOS releases the next updates on EB-5 availability.
