A federal judge rejected the government’s efforts in punishing an immigration lawyer accused of filing meritless litigation. Said case filing delayed the removal of a Laotian immigrant from the U.S. The judge’s decision, according to Politico, serves as a massive win for immigration lawyers and the independence of the immigration judiciary.
The immigration lawyer in question filed for a removal waiver for a Laotian immigrant. This resulted in immigration officials removing the Laotian national from a removal flight and detaining him for two weeks. This is despite the national being in the removal process. Despite the attorney’s efforts, the government still ended up removing their client.
The Department of Justice (DOJ) imposed sanctions on the immigration lawyer, explaining they needlessly inhibited immigration proceedings. A federal judge rejected the DOJ’s proposed sanctions on April 20, 2026. The judge explained the lawyer’s contentions didn’t merit financial sanctions. The ruling states a lawyer making an argument in good faith shouldn’t face retribution from the government.
