The Department of Homeland Security (DHS) is planning on updating amendments to employment-based immigration policy in 2024. The goal is to increase flexibility for nonimmigrant employees and religious workers. Full details of the employment visas update are not yet available.

Updates are expected to address various employment-based preference visas, including EB-1 Priority Workers, EB-2 Advanced Degrees or Exceptional Abilities, and EB-3. DHS is addressing the ability to pay the proffered wage to EB workers, along with updating the evidentiary requirements for each preference category.

DHS will also update employment authorization rules for spouses in specific categories and provider greater flexibility for workers who resign or are terminated. Religious workers updates are also expected, likely reducing the mandated period outside the U.S. required for visa renewal.

Employment updates are likely to be announced in the last half of calendar 2024, with proposals anticipated in August and October.
