In the wake of the government’s dismissal of several immigration judges, advocates increasingly call for an independent immigration system. These calls come after the government dismissed two immigration judges that blocked the removal of two foreign students deemed national security threats. The government’s dismissed over one hundred immigration judges over the past year.

Context

The Department of Justice (DOJ) fired multiple immigration judges since January, 2025.  This is despite the dramatic increase in immigration cases. In their place, the DOJ appointed judges with immigration enforcement or military backgrounds.

Impact

Due to the government’s actions, some immigration courts lost more than half their judges. Per AILA, many immigration advocates began supporting the creation of an independent judiciary for the immigration system. The trend is part of the mounting criticism directed towards the government’s immigration enforcement efforts.
