The K-1 visa lets a U.S. citizen bring a foreign fiancé into the country. This is as long as the couple’s marriage within ninety days of the fiancé’s arrival. Said fiancé has the option of becoming a permanent resident afterward. This option isn’t available for fiancés of lawful permanent residents. They must apply for a marriage-based green card process instead.
Qualifications
The following are requirements for a K-1 visa:
- The sponsor must be a U.S. citizen.
- Both partners are legally free to marry.
- The couple must have met within the past two years.
- The sponsor meets the minimum income requirements.
- The couple marries within ninety days.
Additionally, applicants must submit a Fiancé visa application to U.S. Citizenship and Immigration Services (USCIS). The total application process for a K-1 visa takes about seven to eight months. Couples should plan accordingly.
