The Trump administration continues to update U.S. immigration policies. Among the changes, the U.S. Department of Homeland Security is now leveraging their full extent of authority in carrying out expedited removals. U.S. Immigration and Customs Enforcement can now detain individuals from protected areas like churches, schools, and hospitals. In addition, the migrant protection protocol program, known as “Remain in Mexico” is now reinstated.
DHS stated they will now actively pursue detaining and removing all unauthorized immigrants who have been in the country less than two years. A Federal Register notice is set to be published January 24, 2025, with more details. As such, immigration officials can quickly remove unauthorized individuals without entering potentially lengthy legal proceedings which can extend migrants’ stay for years. The Biden administration limited expedited removals to those found within 100 miles of the U.S. land border and in the country for less than two weeks before coming into contact with immigration enforcement officials. Now, DHS will pursue all found to be in the country without a legal basis, regardless of time in country or where they are found.
DHS also removed the “protected areas” guidance. Now, schools, hospitals and other healthcare facilities, and places of worship are allowed as locations where DHS can carry out immigration enforcement. Concerns from several organizations cite the impact of this change, with individuals afraid to get needed medical help, attend school and church.
The Migrant Protection Protocol has also been reactivated. Known as the Remain in Mexico program, asylum-seekers must wait in Mexico until their legal proceedings are completed. This policy was enacted in Mr. Trump’s first administration and rescinded by President Biden.
