A proposal that protects undocumented spouses of U.S. citizens from deportation is under consideration by the Biden administration. In addition, the Biden administration is considering providing employment authorization to qualifying members of this group. A final decision has not been made. The program, considered “parole in place”, has been used for other populations, including military members families. Under the program, some undocumented spouses are able to access a green card with further access to full U.S. citizenship. In general, unlawful entry to the U.S. blocks the individual from eligibility for U.S. citizenship, if otherwise eligible. This includes marriage to a U.S. citizen. However, the parole in place program grants a lawful immigration status for qualifying individuals.
