Per reports, the Biden Administration is considering executive action to address ongoing issues at the U.S. southern border. As immigration reform remains a non-starter in Congress, the White House is facing pressure from state and local authorities to act. Although Congressional action on U.S. is far past due, some action is considered necessary.
The Biden administration spent months working with Congressional leads to develop a potentially mutually agreeable solution. However, as reported, the proposal was never seriously considered. In light of the current political environment, executive action is being considered. Specifically, Section 212(f) of the Immigration and Nationality Act gives the president some authority to block the entry of specific immigrants at the southern border if their admission is considered ‘detrimental’ to U.S. national interest.
A policy similar to the proposed immigration reform that suggested presidential authority to close the border when certain levels of border crossings are seen is an option. The option is being considered by the White House with no specific plan to activate an executive action.
