U.S. Citizenship and Immigration Services confirmed the receipt of sufficient petitions to reach the congressionally mandated limit of 65,000 H-1B visa regular cap and the 20,000 H-1B advanced degree cap for the current fiscal year. No additional selections are required to fulfill the FY2024 H-1B cap.
For applications submitted and not selected, a non-selection notice will be posted to the individual’s online accounts in the coming days. The notice will show as Not Selected: Not selected – not eligible to file an H-1B cap petition based on this registration.
USCIS continues to accept and process petitions that are exempt from the cap. Those whose petitions are filed and previously counted in the cap retain their cap number and are exempt from the FY2024 H-1B cap.
Petitions filed to:
- Extend the time an H-1B worker can remain in the U.S.;
- Update the terms of employment for H-1B holders;
- Changes to an employer for H-1B holders; and
- Allow concurrent employment for current H-1B holders with additional H-1B positions.
