A Texas judge is hearing arguments as to the removal of a barrier that is floating in the Rio Grande River. The barrier, installed by the state of Texas, is meant to deter migrants from crossing the border. The Biden administration states relations with Mexico are being affected due to the floating barrier. The barrier is part of the efforts of Texas to address border security, called Operation Lone Star. The judge is considering whether to enact a preliminary injunction requiring the removal of the barrier.
The lawsuit, filed by the Department of Justice, argues Texas did not seek nor attain federal government approval to install the barriers. Two days after installation, the Biden administration filed the preliminary injunction request. The administration identified two sections of the Rivers and Harbors Act of 1899 that are in violation. Per the Act, the U.S. Army Corps of Engineers authorization is required to install any obstructions in navigable waters. The Biden administration claim further asks the judge to prohibit Texas from building any other new barriers without approval and permit from the federal government.
Mexico filed a diplomatic complaint stating the country is experiencing irreparable harm due to the barrier, likely violating two international treaties, and could affect the flow of the river itself.
