A federal judge agreed to hold a hearing on June 1, 2023, prior to determining the legality, and future, of the Deferred Action for Childhood Arrivals (DACA) program. The review considers the legality of the Biden administration to create the program. Oral arguments will be heard at that DACA hearing. A group of conservative states is challenging the legality of the program, overall. A group of DACA recipients filed opposing motions.
This lawsuit is the latest in a history of legal disputes over the DACA program. Originally created by President Obama in 2012 by executive order, DACA provides protection from deportation for immigrants brought to the U.S. as minors. In 2021, a federal judge vacated the DACA policy, effectively stopping new applications. A circuit court upheld that ruling. Simultaneously, the Biden administration released a Department of Homeland Security (DHS) rule protecting hundreds of thousands of DACA recipients from deportation.
