The temporary suspension of biometrics submission requirements has been extended for qualifying individuals filing Form I-539, Application to Extend/Change Nonimmigrant Status when requesting a change of status or extension of stay to H-4, L-2, or E nonimmigrant status. The previous suspension of biometrics submission is in place until May 17, 2023. The extension is now through September 30, 2023. The original suspension of the biometrics requirement resulted in a dramatic decrease in USCIS’ processing time for these applications as USCIS intended. The extension of this suspension ensures USCIS’ processing time is reasonable.
Adjudication for these specific categories will proceed using biographic information and background checks. During this specific period of time for these specific filings, fingerprints and photographs are not required for filings to continue. However, if at any point USCIS determines biometric information is needed for any applicant, they may require that information. This will be determined on a case-by-case basis. Appointments at a local support center will be scheduled for individuals where biometric information is determined to be required.
Qualifying individuals who are not required to submit biometric information are not required to pay the $85 biometric services fee during the suspension period. If a fee has been submitted separately from the base fee, it will be refunded by USCIS. If the biometric fee was paid in one sum along with base matter fees, the paper Form I-539 application will be rejected. If rejected, individuals must again file Form I-539 without the biometric service fee.
