The Department of State released the February 2022 Visa Bulletin. In the February 2022 Visa Bulletin showing both the Dates of Filing Chart and Final Actions Dates Chart, we see some exciting movement for Employment-Based second category (EB-2) for India and Chinese nationals. According to the State Departments February Visa Bulletin, the final action cutoff dates for issuing an immigrant visa will be as follows:
- EB-1: All countries, including India and China, will remain current.
- EB-2: India will advance by almost six months to January 1, 2013, and China will advance by more than five weeks to March 1, 2019. All other countries will remain current.
- EB-3 Professionals and Skilled Workers: EB-3 India and EB-3 China will remain unchanged from the previous month. The cutoff date for India is January 15, 2012, and for China is March 22, 2018, respectively. All other countries will remain current.
- EB-5: The Non-Regional Center program will be current for all countries, including China. The Regional Center program has expired on June 30, 2021, and is listed as unavailable in the February Visa Bulletin Final Action Date chart. If reauthorized, the Regional Center category will also be current for final action for all countries except China, which would be subject to a November 22, 2015, final action date.
The Date of Filing chart in the February Visa Bulletin remains largely the same as last month. We only see a two-month advancement for EB-2 India from July 8, 2013, to September 1, 2013. The U.S. Citizenship and Immigration Services (USCIS) has yet to announce on its own website which charts to use to file Adjustment of Status. The movement we see in the Final Action Dates Chart will be in effect regardless of which chart USCIS utilizes.
