In response to an increase in labor needs, the Biden administration stated they will make 22,000 additional non-agricultural seasons work visas available to employers.

Employers across the U.S. reported vacancies that could not be filled with the domestic labor pool. As a result, the U.S. Department of Homeland Security (DHS) and the U.S. Department of Labor recommended the expanded H-2B availability for FY 2021.

The additional visas require employers to testify that their business will likely suffer permanent harm without the additional workers. Employers will also be given the option to immediately hire H-2B workers who are already in the U.S. without waiting for approval of a petition for the additional H-2B visas. 6,000 of the new visas will be reserved for individuals from Honduras, El Salvador, and Guatemala, the Northern Triangle.

The increased H-2B caps are solely available for FY 2021.
