Today, the D.C. Circuit lifted a lower court’s order that barred the U.S. government from turning back unaccompanied migrant children from the border. A COVID-19 public health directive was cited to allow the completion of a review of the expulsion policy in the original order.
In the new order released today, a three-judge panel lifted the injunction at the December 2020 request of the Trump administration. The order says the administration had “satisfied the stringent requirements for a stay pending appeal.”
Whether or not the Biden administration will enforce the policy is unknown. The policy was issued by the Centers for Disease Control and Prevention through Title 42, a rarely used public health law.
