The Department of Labor (DOL) released updated guidelines on how employers demonstrate English language proficiency for foreign workers operating commercial motor vehicles (CMVs). In response, the Office of Foreign Labor Certification (OFCL) published an FAQ ensuring alignment between labor certification practices and Department of Transportation (DOT) safety regulations. The new guidelines went into effect on May 14, 2026.

The new DOL guidelines are as follows:
- Employers must inform their foreign workers of the new guidelines if they’re operating CMVs.
- OFLC evaluates Permanent Labor Certifications (PERMs) and other temporary labor certification applications more closely for positions where operating CMVs is the primary role.
The updated guidelines don’t change the DOT’s safety rules, it just clarifies how the DOL applies them during certification process.
