An appeals court blocked a government asylum ban at the border between the U.S. and Mexico. Specifically, the court found that applying for asylum at the southern border is a right granted by immigration law. The ruling is a major blow to a prominent part of the government’s immigration enforcement policy.
According to NPR, the court panel concluded that the Immigration and Nationality Act doesn’t give the government suspension authorities. Additionally, the court ruled the government can’t institute an asylum ban via its own authority. The government explained its actions were within its rights as the situation at the southern border constituted an invasion of U.S. soil. The court’s ruling reinforces the idea that the government can’t bar asylum seekers without implementing said ban through the proper channels.
