										<content:encoded><![CDATA[<p>A refund of approximately $80 million in work permit application fees is being requested by a group of Ukrainian nationals. The group asks the U.S. Court of Federal Claims to order U.S. Citizenship and Immigration Services (USCIS) to provide the refunds. Fees for work permits for Ukrainian nationals coming to the U.S. are not required, per a previous policy. USCIS no longer asks Ukrainian nationals to pay the $410 application fee for the employment authorization document. However, the group claims that USCIS has refused to reimburse them for the work permit. The group represents a class of up to tens of thousands of Ukrainians who paid for the permit prior to November 21, 2022.</p>
<p>A previous lawsuit was filed in Illinois federal court stating Congress allowed for automatic work authorization in May 2022 with the passing of the <a href="https://www.uscis.gov/ukraine" target="_blank" rel="noopener">Ukraine Refugee Act</a>. Per the Act, the group states that Ukrainian parolees are eligible for refugee benefits, including immediate work eligibility. Further, refugees with immediate employment authorization are not required to pay the application fee solely to receive the physical work permit.</p>
<p>USCIS responded to the lawsuit stating they would no longer collect the work permit fees from Ukrainians. Subsequently, USCIS and the group of Ukrainian nationals were able to resolve most of their legal issues. However, that agreement did not address reimbursement.</p>

										<content:encoded><![CDATA[<p>U.S. Citizenship and Immigration Services (USCIS) is being sued by Ukrainians who came to the U.S. after the invasion of the country by Russia. They are suing due to USCIS requiring them to apply for work access, which they claim is in violation of passed legislation. Ukrainians&#8217; work access, they claim, was included as part of an aid package to Ukraine.</p>
<p>The plaintiffs claim that U.S. Congress provided the Ukrainians with the same benefits as refugees when a $20 billion military <a href="https://www.defense.gov/News/Releases/Release/Article/3088006/fact-sheet-on-us-security-assistance-to-ukraine/" target="_blank" rel="noopener">aid package</a> was passed in May 2022. This includes the ability of qualifying Ukrainians to immediately gain the right to work, without paying any fees. The individuals suing USCIS include over 170 Ukrainians.</p>
<p>USCIS is requiring individuals to apply for employment authorization, a process that can take months. In addition, they are liable for the related fees including a $410 application cost. In the lawsuit, they ask that USCIS apply the Additional Ukraine Supplement Appropriations Act, or the Ukraine Refugee Act. Public access to these documents is not available, as is typical for federal courts and immigration matters.</p>
<p>In the passed legislation, an eligibility clause was added to clarify the specific potential Ukrainians work access benefits. In that addition, they clarify that Ukrainians “shall be eligible” for refugee benefits. The plaintiffs point out that the clarification section specifies they are not eligible to apply for a green card after one year. However, no such exemption was stated for work permits. Therefore, they should immediately qualify for work eligibility.</p>
<p>Over 100,000 Ukrainians have come to the U.S. after the invasion of their country. Additional Ukraine nationals continue to move to the U.S. This lawsuit includes individuals who have come or will come to the U.S. between the dates of February 24, 2022, to September 30, 2023, who have not yet received their employment authorization. The suit asks that the court certify the effort as a class action effort, state that USCIS has violated the Administration Procedure Act by not providing an immediate work permit, and end the $410 filing fee.</p>

										<content:encoded><![CDATA[<p style="text-align: left;" align="center">The U.S. Department of Homeland Security (<a href="https://www.dhs.gov/" target="_blank" rel="noopener">DHS</a>) announced immediate eligibility for individuals from Ukraine for an 18 month Temporary Protection Status, for qualifying individuals. Below is the announcement from DHS.</p>
<p><span style="font-family: times new roman,times; font-size: medium;">The Department of Homeland Security (DHS) announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months.  </span></p>
<p><span style="font-family: times new roman,times; font-size: medium;">“Russia’s premeditated and unprovoked attack on Ukraine has resulted in an ongoing war, senseless violence, and Ukrainians forced to seek refuge in other countries,” said Secretary Alejandro N. Mayorkas. “In these extraordinary times, we will continue to offer our support and protection to Ukrainian nationals in the United States.”</span></p>
<p><span style="font-family: times new roman,times; font-size: medium;">A country may be designated for TPS when conditions in the country fall into one or more of the three statutory bases for designation: ongoing armed conflict, environmental disasters, or extraordinary and temporary conditions. This designation is based on both ongoing armed conflict and extraordinary and temporary conditions in Ukraine that prevent Ukrainian nationals, and those of no nationality who last habitually resided in Ukraine, from returning to Ukraine safely. These conditions result from the full-scale Russian military invasion into Ukraine, which marks the largest conventional military action in Europe since World War II. This invasion has caused a humanitarian crisis with significant numbers of individuals fleeing and damage to civilian infrastructure that has left many without electricity or water or access to food, basic supplies, shelter, and emergency medical services. </span></p>
<p><span style="font-family: times new roman,times; font-size: medium;">Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022. Individuals who attempt to travel to the United States after March 1, 2022, will not be eligible for TPS. Ukraine’s 18-month designation will go into effect on the publication date of the forthcoming <em>Federal Register</em> notice. The <em>Federal Register</em> notice will provide instructions for applying for TPS and an Employment Authorization Document (EAD). TPS applicants must meet all eligibility requirements and undergo security and background checks.</span></p>
