All available Employment-Based Second Preference visas are issued for FY2024. The EB-2 visa is available to qualifying individuals with exceptional ability and those with advanced degrees. Embassies and consulates are no longer able to issue EB-2 visas for the remainder of this fiscal year. The new fiscal period begins October 1, 2024, starting the FY2025 cycle.
The Immigration and Nationality Act (INA) sets the number of available employment-based preference immigrant visas available each year. INA sets the EB-2 visa annual limit as 28.6% of the worldwide employment limit. The State Department and U.S. Citizenship and Immigration Services work together to ensure the limits are reached, to the extent possible.
