A new law enacted by the State of Texas makes it a state crime to enter the state without a legal basis. The Texas state immigration law is scheduled to go into effect on March 5, 2024. Per the law, SB4, state judges have the authority to issue removal orders. The Department of Justice is suing the state, emphasizing only the Federal Government has the authority to create and enforce immigration law.

U.S. District Judge Ezra recognized the state’s ongoing concerns due to the situation at the southern border and ongoing complications as the country’s immigration laws remain unchanged. However, the judge went on to criticize the bill. He completely rejected the state’s claim that there is an ‘invasion’ happening at the Texas-Mexico border.

The State argued that the Texas state immigration law is complementary to federal law and they have the right to defend itself from a full-scale invasion of criminal cartels. The Judge stated he sees no signs of such a situation.

The Judge stated the case will not be ending quickly and alluded to ultimately going to the Supreme Court.
