The Office of the Citizenship and Immigration Services Ombudsman is providing updates on the F-1 student visa with a filed Form I-907, Request for Premium Processing Service, the Form I-765, Application for Employment Authorization. The Office is receiving reports of delays in the premium processing timeline for their employment authorization document (EAD). The update outlines expectations, timelines, and a suggested process if delays are encountered.
The following are key to a successful outcome for premium processing:
- File Form I-907 online if possible. If not, ensure the correct USCIS lockbox is used when mailing documents. USCIS Direct Filing Addresses for Filing Form I-907 for Form I-765 or Form I-539 are online. Using the incorrect mailing address triggers, a rejection, which requires additional review, submission, and the entire process starting again.
- The 30-day premium processing timeline excludes the time required to produce the actual EAD. It’s important for those who request premium processing to understand this additional time need.
- USCIS is required to complete one of the following options within 30-days:
- Approve the petition,
- Deny the petition,
- Send a Notice of Intent to Deny, or
- Send a Request for Evidence (RFE).
If approved, USCIS generally produces the EAD within one to two weeks. The EAD is mailed via U.S. Postal Service (USPS) Informed Delivery. The actual receipt of the EAD is dependent on USPS delivery times. The USPS tracking number for the EAD is available on the individual’s USCIS Case Status Online page. If the USPS status shows delivered and it has not been received, review the Frequently Asked Questions page in the EAD section.
If the EAD is not received within 30 days after approval, individuals should submit a case inquiry.
It is important to note, in order to start working, an applicant must have in their possession the EAD card and must be able to present it to their employer. Unfortunately, just having the approval notice does not give applicants work authorization.
