An order requiring green card applicants to have health insurance or show how they will pay for benefits is revoked. President Biden officially lifted the Trump Administration order. The original order was challenged in court and was not enforced.
President Biden stated the policy does not advance the interests of the U.S. and the expansion of access to affordable health care will not bar noncitizen entrants who immigrate lawfully.
The entry ban, originally introduced in October 2019, required those wishing to immigrate to the U.S. prove coverage by an approved insurance plan, including employer-sponsors, unsubsidized plans, family plans, or show the financial capability to pay for foreseeable medical costs.
In November 2019, an Oregon federal judge halted the proclamation. The judge stated health insurance is a domestic policy and therefore under the jurisdiction of Congress.
Biden stated his administration will review any related regulations or policies developed in response to the original ban.
