Employment First Preference (EB-1)
The first preference for employment based Green Card applicants is for -
- Persons of extraordinary ability in the arts, the sciences, education, business, or athletics
- Outstanding Professors and researchers, and
- Managers and Executives of multinational companies.
Applicants under this category are not required to obtain a Labor Certification, as the inclusion of such person is seen as beneficial to the United States in the field. Any foreign born person applying under this category will be required to have extensive documented proof of his or her extraordinary ability and be recognized in that particular field.
Employment Second Preference (EB-2)
The Second preference for employment based Green Cards includes -
- Professionals with advanced degrees
- Professionals with exceptional ability.
- Physicians working in underserved areas under federal programs
Generally EB-2 applicants are required to obtain a Labor Certification through their employer but can file for a National Interest Waiver, which waives the need for a job offer and a labor certification under the consideration that the person’s induction into citizenship will be in the nations own interest.
Employment Third Preference (EB-3)
The Third preference for employment based Green Cards includes -
- Professional workers, holding H1B equivalent jobs.
- Skilled workers having undergraduate degrees and a permanent job.
- Unskilled workers with minimum education and working as labor in under-manned industries.
Applicants under this category are required to obtain Labor Certification unless they fall under a few selective exceptions.
Employment Fourth Preference (EB-4)
The Third preference for employment based Green Cards includes -
- Religious workers
- Us Government Employees
- Translators from Iraq or Afghanistan working for US government
- Physicians
- Dependents of diplomats
- Children in foster care
- Employees of American Taiwan Institute (for more then 15 years)
- Persons serving US armed forces

Employment Fifth Preference (EB-5)
The Fifth preference for employment based Green Cards includes -
- Investors willing to put $1 million into a U.S. business or
- Investors willing to put $500,000 if the business is in an economically depressed area
- The investor must also employ at least ten workers.
While applying in this category, applicants need to prove that their investment or entrepreneurship is financially beneficial to the US economy.
